Can I sue for this??

Ok, well this is the 2nd time its happaned. One of my images has been appeared in a magazine without any credit to me.

This time its a magazine in the USA. And not out of the country like last time. Its Car and Driver Magazine, and they have my school bus in the Reader Sightings.

Now, I have proof of the picture,the psd,and the original. Is there anything I can do about this at all? Or really nothing???

Usually, if you rip off a stock agency, they just make you pay a fee. I don't think you should sue. The most a judge would give you is the current flat rate for the image. Email/call the magazine and let them know, as well as threaten them with a small civil suit, but I would say try and just get the money from them first.

Thats from a reader though isn't it? Explain the situation and where the original photo is located. If some dude ripped you off, its not Car and Drivers fault. You may be completly out of luck.

Damn this sucks. Even though they published it? I would imagine they are responsible for all the contents printed on the mag.

They would be responsible if it was anywhere else but a reader submited image. Basically they have to take the guys word for it, how could they follow up all public submited images? I know we are very careful in properly crediting images, even when we get free ones to use, we check the user agreement and what not. But if someone sends us an image, 99% of the time we have no reason not to believe it's theirs.

yes I see your problem.
But if you don't get anything out of it, you can always put it in your portfolio.I actually would be glad if someone printed some of my stuff.

well sure bjorn .. but he still doesnt get the credit .. ;)

anyway, i think spectra is right.. i dont know if you can sue the submitter then?

Yes I know he should get some credits...
But that was IF he wasn't able to get any...
Then he should still try to think positive
