I emailed them 3 times asking them to remove it. They claim it is not the same graphics. I say they are wrong. I'll let you guys decide and take the appropiate action ;)

well...if its not a rip...it EXTREMELY inspired.

Im with you....i gotta say rip. He changed about 2 colors & made the highlight brighter. Other than that...just about everything is the same
-same blue ball, same shadow and highlight on the ball
-same 2px line on the header
-same angle of the curve where the 'plastic' begins
-same triangles on the bottom left of the layout (with what look like the same pattern as your triangles...just horribly compressed)

I think you get the point. Go get em! (or atleast thats my advice)

EDIT : Just to add fuel to the fire, I took a screen shot of both your layouts, scaled them down and they just about fit together perfectly. His layout is stretched about 4 pixels wider, but when i scaled it on horizontally....it just fit into place.

I think what they did was copy yours exactly and then change a few VERY small things to say that they are not the same. But I would say go after them... its your hard work that they are trying to claim as theirs.
