Ctrl + J without a selection will make a duplicate layer
Ctrl + J with a selection makes a new layer out of the selection
Background layer is always locked, but double clicking on it (in the layers palette) will unlock it. Duplicating the background by Ctrl + J or by dragging the background to the new layer icon should not produce a locked layer.
