create action for frame around photo?

Hi,
I would like to automate the creation of a frame with top rounded corners around images as shown in the image below. The rounded corners should always be the same size and angle no matter the size of the picture.
I'm having problems creating and recording a suitable photoshop action that would work for any picture dimension and that won't resize the top rounded corners.
Any ideas?

As I'm sure you are already aware: you'll have problems with this if, as in your sample photos, they are of different orientations... Setting up an action to do this isn't really a problem, as you probably have already figured out. However the photo size and orientation will be.

Most likley this can be best handled with photoshop scipting along with an action. As I've said before on this forum Photoshop I know... Scripting I don't. I do however know where the Photoshop scripting gurus hang out. As much as I hate sending someone somewhere other than this site for answers, I hate not helping someone to their solution even more.
