is it possible to merge 2 different shapes to make it one?

i have to rasterize the bottom layer first .. ya?

You don't need to rastorize to merge shapes. If you rastorize then it's not technically a shape anymore.
You just need to get the shapes on the same Path layer. You can do this by selecting one shape, do CTRL+C then target the other Path layer and paste. Now with them both in the same layer, select your PATH SELECTION TOOL (black arrow), highlight both shapes and press the COMBINE button at the top of the window in the current tool preferences section.
