Probably not but...

...(mainly for US people) can you file a lawsuit for someone or file a lawsuit in someone elses name?

Here's the deal.

My mom's ABS (Antilock Brake System) pump went out on her Honda on Thursday. Well, it had lost pressure a day or two before that but she took it in on Thursday. They replaced the pump, inspected her brakes and supposedly took care of everything that was wrong.

On Friday (yesterday of this post), she was pulling into a parking space in front of a building and her brakes completely went out, she hit a large column in front of the building, f'ed up her whole front end, quarter panel, door, cracked the windshield (hard hit) and really f'ed the whole front of the car up. (part of this was due to a car parked beside where she bounced off and hit it, messing up the side of the car).

I'm having a hard enough time in talking her in to letting me go with her when she goes to the Honda place to talk to them. She's a very, not so aggressive church person, and I know she'll go down there and let them walk all over her. She's just not the type to argue with anyone over anything. I am. I'll have her in a new car before I leave, lol.

Now luckily it happened the way it did. Her next trip was down the major Boulevard in this city, and she could've been doing 45-50 (average speed) and rear-ended another car, or ended up in an intersection in much worse condition, other than the cuts, scrapes and bruises she ended up with.

From what I hear (I need to talk to Honda) but they're acting like they're taking no responsibility in this. Well ok, you just worked on her brakes, and the next day they go out and she f's up her car. Not even giving her a car to drive while they have hers. Her insurance only gives $16 a day for a rental. Anyone here ever rent a car for $16 a day? Well if so, it doesn't happen here.

If they deny all claim, I know she won't file suit, which leads to my original question. If she doesn't, can I file one for her, or file one in her name? If it's filed, I can get her to follow up on it, but she won't initially do it herself. I'm not letting them slide on this. Not really coincidence that they work on it, her brakes completely fail the next day. She's never had a problem with this car until now (other than typical minor maintenance).

No, I'm not asking for non-lawyer opinions on the incident, I would however like response in my actual question.

Well, if I knew or I'm living in US probably I'd reply.
We here in Singapore can file these lawsuits to a goverment division called CASE.

The answer to your original question.... "I don't think so"

You'll have to talk HER into a suit, from what I understand. Keep in mind though.... this IS Alabama (home of the lawsuit) So you never know. I would say that you should get her to go talk to a lawyer. Most of them will hear that story and take care of everything. That way your Mom doesn't have to be the bad person.

You should probably have a lawyer be the person to do the talking when going to talk to the honda place too.

Yeah, I'm trying to talk her into it, it's just not working well.

And, I'll probably need a lawyer after I go to the Honda place, lol.
