Well, in all fairness, you don't own the copyright to either the logo, or the brand, so really neither of you are 'right' although he is really treading in dangerous territory in that he is trying to sell copywritten material, the D-12 name. Thus, I don't think you can sue, but he's definitely in the wrong. Your image was a piece of not-for-profit fan art, correct? Well, if that's the case, you should be ok, whereas he is trying to make a profit off of it. Although I'm sure bootleg merchandise appears all the time on E-Bay. |
