I disagree, if it's just inspired go use a different color theme, this is definitately a rip.

It is just somebody with No original design skills or thoughts. A rip (to me) is only if the graphics are stolen.

It looks like he attempted to make the graphics himself. Yes it's wrong but I really don't bother with people like this since they didn't actually "steal" anything.

I would probably consider this a rip... yeah they didnt actually steal the graphics, but the sure as hell stole the style, color scheme, idea, layout/placement of objects... etc.. the list could go on for a long time. :p
